Clay Theater Conditional Use Application 2021-010176CUA (For your information - already sent to each commissioner) I am writing to you to voice support for preserving the Clay Theater and to ask you to deny the owner<U+2019>s Conditional Use Application for a change in use. My attached letter presents the following points: <U+2022> The hardship exemption in Section 303(j) is not available to the present owner because he purchased the building 4 years… (For your information - already sent to each commissioner) I am writing to you to voice support for preserving the Clay Theater and to ask you to deny the owner<U+2019>s Conditional Use Application for a change in use. My attached letter presents the following points: <U+2022> The hardship exemption in Section 303(j) is not available to the present owner because he purchased the building 4 years after the code section took effect. He cannot claim that he has been harmed by the city<U+2019>s restriction. <U+2022> The applicant has failed to properly disclose the conditions of his purchase of the Clay Theater, and the analysis in his application does not respond to the question of <U+201C>fair return on investment.<U+201D> As the facts show, the owner<U+2019>s investment has been highly successful. Again, there is no basis for granting a hardship exemption. <U+2022> The owner has acted to sabotage efforts to resurrect the theater as a viable entity under the management of a neighborhood non-profit, which is the only business model available at this time. This behavior in defiance of the intent of the Planning Code should not be rewarded. Thank you for considering these issues.show more
