My comment is concerning the community safety element. I noticed that there are only three policies that are listed on our hard copy on page 90; policy 2.4, 2.6 and 2.8. Joseph Ferrucci Our law firm was recently retained by Chesly's Home, a development company that controls some properties in the East SOMA area on Harrison between Second and Third Streets. We have just begun to examine the Draft EIR on behalf of our client and were very surprised and concerned that it does not appear to consider a higher density development of taller building heights on the western slope of Rincon Hill. Currently, there is a tower rising at the top of Rincon Hill to approximately 600 feet. I urge the Commission to consider taller building heights on the western side of Rincon Hill. Marideth Tomas, Neighborhood Parks Council The Draft EIR does not adequately recognize that parks and recreational facilities are an essential component of healthy neighborhoods and can not be replaced. The draft memorandum of the San Francisco Eastern Neighborhoods needs assessment stating that 14.5 acres of land would be needed for open space and parks under the plan's rezoning scenarios. The EIR should be amended to include corrections in the existing inventory and include enforceable mitigation requirements that will ensure that adequate publicly accessible park and recreational facilities are included as a condition of increased residential density. Robert Mayers I would like to discuss errors in the East SOMA existing land use map, figure 7 on page 39 of the draft EIR. The map overstates the presence of PDR uses in this area. It was announced that this area would be zoned mix used with affordable only housing as an overlay. Our survey has found 20 buildings in a small area that the map mis-spoke as PDR. Some of them are multistory large office with retail mixed use but no PDR at all. Our concern is that SLI [Service Light Industrial] in the area is being replaced with modern economically viable office type uses. Have the map revised to reflect what is actually out there. Alvaro Sanchez We believe that the Eastern Neighborhoods is a wonderful opportunity for us to be able to work with the City and be able to reach the goal of building more affordable housing. The DEIR does not really reflect the need of affordable family housing as required in this new zoning process. There is a lot of language about affordable and inclusionary housing. Chris There is a new measure coming out about parking increase and it is going to have a really significant impact in the Eastern SOMA and I would like to see some ways to capture that impact. Other thing is the Housing Element and how that impacts the timeline of the process. I would like to see a published timeline about how it is going to be incorporated. Marilyn Amini You have four substantial areas in San Francisco being proposed for land reclassification. Two are transit oriented districts. In the DEIR, there are only seven lines describing those districts whereas in the plan that contains the legislation for those districts, there are 200 full pages. People who reside in these areas have not received notice regarding the proposed reclassification and CEQA Chapter 31 requires that there be early on participation of people. The time for consideration of this Draft Environmental Impact Report should be extended so that all members in the community are able to respond due to the Summer Hiatus.show more

The allowance of 4,000 square feet per lot for retail is much better than the 2,500 previously proposed, but it means that you may only have 40 feet of a 200 foot frontage. Why is the area around Franklin Park proposed to be zoned PDR? Mark D'Ambrosi Requested change to the language in the plan to allow office space above the first floor PDR use rather than above the ground floor [Bryant and Brannan Streets] Requested the same height limit that is proposed on Brannan Street to be on Bryant Street as well - 65 feet. Juan Calaf From our analysis, it appears that full consideration has been given to South Park to maintain relatively low heights in the area thereby preserving its character while at the same time the height increases in the SOMC area would likely shade out most of the existing residential. Diana Wu The proposed height increases in the SOMC area and along many of the other areas will have significant environment impacts for residents as well as businesses. Requested to maintain environmental impact review process and procedures because it is very important for all of us. Sal Gonzales Appreciated the 65 foot height recommendation for 24 th and Harrison Streets. We own two parcels at that corner and we are requesting them to be zoned NCT. Sarah Murray Concerned with the recommendation to not allow any residential uses along 16 th Street. We do not want to loose services that are existent in the neighborhood. David Solis It does not make sense to change zoning in a neighborhood that is already established [Dog-patch] and I'm requesting that you change the proposed zoning to UMU. Steve Vettel We had suggested that in the innovative office district, where the American industries are, there could be either 2,500 square feet per parcel or up to .25 FRA, whichever got you the greater number. It is particularly important on Third Street because it is a transit corridor like 16 th Street. Those industrial buildings along Third Street do not really function as industrial and it would make more sense that in some of those buildings to have some retail. In the PDR-1-D-district in Show Place Square, art schools are permitted and student housing use in conjunction with those schools should also be permitted. Kepa I am wondering how the department is planning to address the reality of transit at Showplace Square/Potrero Hill because it is essentially nothing in terms of public transportation. Tony Kelly The point of student housing in the PDR-1 districts: things that can support the culture of arts would be terrific. I do not think that the current proposal about personal services and gymnasiums really solves the issues. [Inaudible] My neighborhood is basically built out and there is construction going on that is making a lot of noise. The only little green space is in the Mission and that has been taken over by dogs. Sue Hestor We need to have sidewalk standards and they need to be imposed. Areas like 16 th Street really need street lighting. As a Planning Department you should be able to ask other departments to do something about it. Non conforming uses, letters of determination do not involve the public and it should. Joe Boss The gymnasiums should have some kind of portability of at least three blocks because they get bigger over the years and we do not want to have empty lots. Datoan Thropp I am really happy that some improvements are being made especially along 16 th Street. But I am also urging you to consider some controls on residential in the PDR districts. Fred Snyder 16 th Street is a mayor transit corridor and we need to do more along those streets if you are making more housing available there. Greg Miller For grocery stores, it might be good to have some sort of process like CU and it may be worthy of consideration to try to fast track grocery store CU's so they do not get stuck in the process for two years because they are absolutely essential to families in the City. Scott Thiper Requested to have another community meeting between owners, the Eastern SoMa Plan, the Western SoMa Plan and MEDA to work on the interpretation for PDR. Bob Mayers The plan is to down zone larger areas for PDR, but no one as yet has been able to give any examples of the new PDR moving into these areas. Food service sector has growth, employing 38,000 people in the City, and none with a 4-year degree. Our concern simply is that if we are creating new PDR districts, what sort of jobs and employment can we expect to be in those districts in the future? Food service sector has growth, employing 38,000 people in the City, and none with a 4-year degree. Unfortunately the average wage is well below the median income of $50,000. As a city, we want to get into a job sector that pays more than the average way for people without a 4-year degree and that have seen growth consistently over the last 10 years. Those sectors include some conventional PDR sectors such as the specialty of building trades, broadcasting, construction, and some interesting sectors like computer system designs. Future oriented PDR objective: Set aside enough land with restrictions sufficient to prevent wholesale transformation to conventional office or residential uses. The key is to provide zoning with enough flexibility to allow for the evolution and growth of existing and new innovative industries. We are in support of the PDR proposed by the Planning Department and we are attempting to provide a link between land use and workforce development programs. Owners would need to apply for a permit as a privilege not as a right. Something we have now that we did not have before is the ability to track each building through the Treasurer's Office data and identify when a change occurs, or when a new business has moved in, to meet with that business and determine if they comply. Tony Kelly, Potrero Boosters The overview of the Commissioners is that this plan does need serious attention and amendments to really have community support and really reflect the community based planning process that has been going on for the past 8 years. There is a need for serious attention to these large rezonings, to pay attention to the affordable housing crisis as well as the questions of office space and industrial land. Keep in mind that these are under served neighborhoods. Regarding office and industrial space, we are being asked to consider accountable economy where some jobs push out other jobs. There is enough land to cover these needs in the Eastern Neighborhoods and elsewhere. We have been working with stakeholders in the Mission and South of Market. We are in full support of what they will present today on affordable housing and family youth zoning. Sue Hestor I want to talk about the review of projects under the plan because you have not really talked about how cases are going to disappear from the Planning Commission Calendar but I want you to focus on it. The Zoning Administrator has a lot of power, Commission has some, and the public has not a lot. There is no discretionary review allowed, at all, on large projects. You should pay attention to the pipeline because it is like a phantom list because you think you would be getting a lot of affordable housing. We all have massive displacement, controversy and intrusion with market rate housing. Mission Coalition for Economic Justice and Jobs In 1993 a Community Plan was put together by the Planning Department that took two years with artists, businesses and home owners. There was a need to protect existing industries and the opportunity for future industrial growth and development. One of the essential components of the opportunity for industrial expansion is the preservation of appropriate land for industries of the future. This proposal was about to create an industrial neighborhood, subsidized affordable housing, live-work, and industries for the future. We are concerned that a third of the area is going to become non-confirming use. We really need to rethink our neighborhood because we are large scale buildings. We have been tracking PDR next to very large housing complexes. We need to look more to the knowledge based businesses that are more compatible with residential. Regarding housing, we really have to look to middle income housing. Kate, North East Mission Residents Can we keep PDR and save the jobs? Honestly; what we see in the industries that are manufacturers that have low cost products trying to compete on low cost services, these companies are increasingly having a hard time staying in San Francisco because it is not actually the best business deal for them. There are companies like Mission Linen, with decent pay serving the downtown businesses that are going to be living the northeast Mission and there is nothing that zoning will do to keep them. [Presented different business types in the northeast Mission that want to stay in San Francisco.] We think that for larger parcels, it makes great sense to allow owners to subdivide into smaller spaces. I do think that continuing to look at economic incentives is critical. Marilyn Amini You are going to be asked in a resolution before you to find consistency of this whole area plan with the General Plan. That is not going to be possible because the 2004 housing element was found by the Court to not have an adequate environmental review. In this material, RTO is printed as if it was already adopted. That was included in the Market-Octavia Plan but that is under appeal. Sara Marie, North East Mission Residents Association Members have been actively talking with many individuals and stakeholders in the North East Mission in the past months to listen and develop our thinking. Our goal is to ensure that our neighborhood continues having a diversity of people, businesses and uses, to continue to be a vital incubator for businesses, and to meet the over 6,000 need for housing. The current proposal to rezone the area from M-1 to PDR is too narrow and restricted to accommodate the residential needs of our neighborhood. We believe that residential with the right kind of PDR can exist because it already exists in our neighborhood. [Presented photographs of the area from Folsom between 16 th and 18 th Streets to show the existent mix of residential, office and PDR uses that are compatible.] Mai Don, SOMCAM After months of walks throughout the SoMa streets and alleys, we came up with the Youth and Family Zone because it is the solution based upon the voice of its existing residents to prevent family displacement. We recognize families as not just parents and their children but also none traditional families. SoMa youth and families are struggling with many issues including invisibility, displacement, traffic, lack of affordable housing and spaces for youth. If the Eastern Neighborhoods is allowed as it is, SoMa would loose the members of its community as they struggle to find more affordable housing elsewhere. April The SoMa neighborhood demographic: 60% of families earn yearly less than $25,000, 82% with no college education, 44% are foreign born, and 33% are limited English speakers. We really need to see how the plan incorporates this particular vulnerable constituency with other types of uses that may not consider their needs on housing and jobs. Because this is a small part of the plan, we would like it to be oriented to youth and families. The goal is to support and enhance children, youth and families investments that can stabilize existing residents and community institutions. - What we see as permitted institutional uses would be centers for youth and seniors and not permit liquor stores and movie theaters, massage parlors, etc. Jazzie Collins It is important that we preserve the character of the neighborhood and we wish that the SoMa Youth and Family zone be incorporated into the plan. And as such, we do not need liquor stores or massage parlors in our area. Mary Duran, Youth Organizer - PODER We need a community plan and what the community wants is affordable housing, better quality jobs and local small business protection. Nick Pagaoulatos, MAC [Mission Anti-displacement Coalition] Our specific policy recommendations around PDR is to preserve and promote the growth of production distribution, repair businesses and jobs that need isolation from other uses in order to avoid land use conflicts. This is really about land value and making sure that we have adequate controls to make sure that existing industries are able to stay in our neighborhood. Fernando Marti, MAC The UMU zone is currently a mixed use area and we want to keep it like that but how do we control land value? We would like to see 30% of inclusionary housing zoning throughout the UMU, Transit Corridors and the RTO zones and 100% affordable housing for sites of 10,000 square feet or higher. We would like to see base heights allowing base percentage of affordable housing and then allowing greater height for 100% affordable housing: The Mission Street base height of 55 feet with 30% inclusionary and allowing up to 85 feet for 100% affordable, Valencia Street at 45 feet but allow 55 feet for 100% affordable. Jaime Guerrero, MAC Regarding small businesses and retails: we recommend not permitting smoke shops, liquor stores, tourist hotels, adult entertainment, and massage parlors in the UMU and RTO zone. In the NCT district, we propose having bars to be a conditional use instead of permitted use. We are also asking that movie theaters and art activities be a conditional use conditional on the neighborhood and families service. Lydia Tan, Breach Housing Corporation I am here to talk to you about a slightly a different issue. Breach was recently selected by the San Francisco Housing Authority to be the redeveloper of the Potrero public housing projects in the Potrero Hill area, 22 nd and the west side of Pennsylvania. This particular area is not being considered in the Eastern Neighborhoods Plan. It needs to under go its own rezoning. Some of the objectives that the Housing Authority, Mayor's Office of Housing and Breach Housing are doing is trying to reintegrate this neighborhood back into the overall community. We are hoping that the redevelopment of this particular area will provide economic financial sustainability for the public housing units that are there and they can stay there for the long term. We would like the Planning Commission to think about perhaps expanding this line to include some of the properties that are adjacent, not a rezone or land use designation. Keep open the idea that we might look at a rezoning in the future as we finish and go through our land planning process. Bill Lightner Although I am delighted that the SEW [Small Enterprise Workspace] designation is moving along, I am concerned with the way that it is being framed. They are proposing that this would be for new construction only and I see it as a provision for existing buildings. I do have a survey of rents that we produced of staff's request and we will provide that today. Judy West I am concern with the fact that the land on Harrison and Folsom Streets are quite different than the land around the top of Potrero Hill, Franklin Square Park area. The impacts of the zoning on existing buildings that are either on liquid or solid bedrock are huge and you are not considering this when you are talking about heights and upgrades. Debra Stein How do we make certain that good and current employers stay in the Eastern Neighborhoods? Eastern Neighborhoods recognize that multimedia looks like an office and it is an office. Any legal existing multimedia should be a legal non-conforming use. [No name stated] Somewhere along the line there is a disconnection between what is being built and noise. There is a density level where it is just a little bit too much. Suggested that if you have new construction for apartments or condos, they need to dedicate spots for pets and pay extra fees because they are going to go to public parks. Allan Marko The proposed zoning of PDR at Pennsylvania and 25 th Street is incompatible with what exists there with residential. This area should be considered for Urban Mix Use. Jennelle Gothers Over the last 8 years various conditional uses have been granted in what is currently M-2 zoning between 23 rd and 25 th to allow those condominiums to develop. The proposed UMU zoning in the Dog Patch just stopped short. Encouraged to extend it to include the blocks of 23 rd and 25 th , Indiana and Third Streets. Brett Gladstone Non-conforming uses, there are hundreds of these types of businesses all over. Without further direction from to the Zoning Administrator, he will be forced to ask them to relocate. A lot of the great companies you have heard about today would have to leave. Stephen Kolk, Consultant of San Francisco Opera Warehouse The Opera is interested in redeveloping the site of 800 Indiana Street, probably to rental housing. Requested that the plan increase the permitted height on this block because it is critical for feasibility to any project on this block. David Solis The area of Indiana Street is currently M-2 zoning and it successfully attracts a mix of uses. Concerned that the proposed PDR zoning will have a negative affect on our neighborhood and safety. Phillip Lesser For housing, you need to have a large print and that is what we have on 16 th Street. You should go to 85 feet just like Mission Street. Likewise, around the BART station. We are a transit first City and we need to put the people before that transit. [No name stated] I appreciate the dialogue that has been happening in the last few weeks but now it is time to hear from those who would be impacted by this plan. As the industry evolves so should the zoning to accommodate businesses. Does the City want to promote good businesses that provide jobs and a tax base? Greg Miller I just want to let you know that Lynn Sedway Group of Land Use Economists has been engaged to make a peer review of the report with respect to the proposed increase, affordability exaction, and Eastern Neighborhoods fee. We are hoping to bring you the report of the peer review by next week. I noticed that in the North East Mission there were people that were seemingly on opposite side and have different complaints about this proposal that actually ended up by really understanding some of the issues and conflicts with the intent to preserve the PDR uses. There are some really good ideas that hopefully will address a lot of issues as the dialogue goes on because it is not over; it is just the beginning. Nick Pagaulatus, Mission Anti-displacement Coalition We are having community dialogues around important issues. We found out that we have a very strong intent to continue working together as a community to craft something that it is going to be implementable by the [Planning] Department, enforceable by the City, and that is really going to work in meeting the goals that we have as business owners, properties owners and workers in these industries. Kate We feel that we need to continue a clear focus of task force to work out the implementation details. Let us recognize where PDR has become offices and where there are thriving businesses. We need to make those places continue and turn back. We want to encourage that no matter what we do, we want these buildings full of productive thriving businesses; we do not want vacant buildings. Brett Gladstone Thanked staff for introducing the idea of compliance period for three years but what would be the fees? When can we see the City Attorney's language on this? They need to tell us tonight what they are producing and give us some information regarding those fees. Tom Radulovich The Eastern Neighborhoods is heading into the right direction but I want to make the last pitch to really look at ways of accomplishing all the goals in the rest of the Mission. We would like to see the RTO zoning expand into all the R zone areas and the NCT zoning use into the neighborhood commercial in the Mission District. John Elberling We absolutely opposed to the rezoning of our neighborhood, Central So. of Market, because it is a very well mixed use commercial and residential. We would like you to do instead is to take this district out of the rezoning and do a follow up process next year that is a really community based. Steven Weaver I live at 1325 Indiana Street and am here to register by opposition to the zoning from 23 rd to 24 th that the area to the North is a multiple use and ours is a PDR-2. Reza Ghobadian I also live at 1325 Indiana Street and it does not make sense to have our block for PDR zoning. Asked to reconsider the rezoning of our neighborhood to an urban mixed use. Mark D'Ambrosi We are experiencing a very high vacancy rate at the present time, at 888 Bryant Street. Requested that the first level qualify as PDR and the height requirement be 65 feet. Phil Robinson and John Hays, Director of Wild Brain We are a creating animation studio, not an office, and animation requires drawing, a lot of creating art, coloring, painting and putting the drawings up on the wall. I support the idea of not having Conditional Use or soft-caps on the higher density areas. Glenn McNulty The plan is not protecting us [local small business] but puts us all in a straight jacket. PDR restricts our ability to grow and I am asking to extend UMU designation to the neighborhood on Indiana Street. Jeffrey Leibovitz I think is a bad idea to have a Conditional Use on all retail in the SoMa area because it would put even more burden to small businesses. Tim Colen We urge you to support the recommendations that staff has given you because this plan is very good and ready to move forward. Meredyth Skemp Staff is doing a great job and we are very excited about the middle income housing in the UMU, the retail controls along 16 th Street, and the allowance of student housing. Alexis McNulty Our neighborhood is only 5 blocks and we are asking to be extended to the UMU zoning. We represent less than 7 percent of PDR land at the Water Front area so it would not change the plan significantly. John Tedesco Concerned of the new PDR zoning and how it would affect my business limiting the type of business or residents to move in. Requested to consider extending the UMU zoning to Indiana and Tennessee Streets. Sarah Karlinsky Two points on the July 10 th staff's memorandum: (a) financial feasibility: stay strong on keep rooting to have the fees on the financial feasibility analysis, and (b) RTO: I am very supportive of it and the elimination of the density cap. Tony Kelly We are in support of general direction on the office PDR and I think you should investigate a little bit more about SEW because it is a new concept and we do not want it to be too much powerful incentive. We think you need to work harder on affordable housing in the Mission District, SoMa Youth and Family zone, and increase height on the Central Water Front. Jaime Guerrero We remain concerned about 16 th Street. We long have advocated for a UMU or other solution to activate this street. David Prowler I really like the RTO, the removal of the Conditional Use and the density cap for housing, and the revisiting of fees over time. In an earlier staff memorandum about large UMU historic rated building permitting above first floor office and innovative industries, I think it was a good idea and you should reconsider that. Fred Snyder I think we can do a lot more to make the neighborhood a lot better and I would like to participate on that discussion. Debra Stein The building where Mission Linen is has been spot zoned in a very inconsistent manner. This is not a PDR neighborhood, area or block. We need to recognize that this is a vibrant mixed use neighborhood. Richard Lawson This proposal is eliminating the opportunity to grow my small business at Tennessee Street. Requested to zone this area as UMU. Gregg Miller Asked to direct staff to modify the height of the Bare's property [SLI] to be uniform height at 85 feet because that parcel is a mix match ranging from 85 feet at the highest to 45 feet at the lowest. Leonard Lynch I am here to oppose the down zoning of the area that includes 1150 25 th Street as it would affect the constitution of this area and the neighborhood. Carolyn Hosoda Asked to review the zoning to UMU at Tennessee Street because our neighborhood has evolved into a much safer and better kept neighborhood. I have been having a lot of trouble finding a place and I am considering a parcel in the Bayview. Right now it is going to fall under the PDR district and based on the current proposed amendments, it will not be allowed anymore. Judy West I would like to speak on the retail overlay along 16 th Street, on the far Eastern side, which I think is a good idea. Please consider that similar retail component along Potrero Avenue in the vicinity of 16 th and 17 th Streets. Chris Durazo I am very disappointed with the way that our proposal for a Youth and Family zone turned out. Staff presented three different zones within the Youth and Family zone in the SoMa without necessarily having a vision for them or the relation to them at the ground level. What we are proposing is something that seems as a threat but in reality is 0 to 120% AMI. It is very broad. Steve Conez I am really here to express gratitude for taking this very seriously. Brett Gladstone I hope that the office portion of PDR-Hybrid will not count toward the Proposition M limitations. I also want to make sure that we talk more about the SEW [Small Enterprise Workspace] and the retail in the 16 th Street District and I would suggest a compromise because it would be good for 16 th Street. Regarding legitimatization of tenants, I want to make sure that it is clear that it's payment over time with the fees of what is allowed. Philip Lesser The environment is the most important thing that we need to protect and it does not have to be at the expense of jobs. We need to provide the housing that will have the workers that then will attract the businesses. Tom Radulovich We think that there should be four neighborhoods CAC to really guide how the $10 fee per square foot is spent. Think about that instead of one Eastern Neighborhoods CAC. We think that the neighborhood commercial on the Mission that are still NC-1, 2, and 3 that NCT is a much better zoning for them. The RTO zoning would make a lot of sense on the entire Mission and not just on one corner. Jazzie Collins, SoMa I want to see less density, more low income families, parks, and schools to have a place that feels like home. Tom Gilberti The proposed code changes for the area are going to be 60 beat 65 decimals and with these levels, you can not escape from the noise. David Prowler, 888 Brannan The hybrid proposal is very intruding to use and I am happy to hear that a compromise has been worked out and am looking forward to see the language. Height issue for 888 Brannan: we would like you to consider asking staff to continue the 65 foot height zone all the way to the back of our block. Marilyn Amini It was stated by Mr. Rich that there will be a new staff report next week and the action is scheduled for next week. Questioned how the people would have the opportunity to review material and respond to it. The high cost of material affectively prohibits participation of the public. Satoru Hosoda Thanked the Commission and all the people that took the time to meet with our group, TTMI. Eric Tao I am glad that the PDR policy passed tonight because it provides certainty. It is important to understand that not all the pipeline projects will benefit from any of the Eastern Neighborhoods plan. Those who will benefit should pay the full fee. Reuben Hechanova We support the middle income housing, retail control on 16 th Street, removal of RTO soft-cap density limit, student housing, no conditional use or no density limits, pipeline projects to be grandfathered from January 19, general use and height. Concerned about the affordability fee analysis. Sue Hestor You need to go to the Health Department and ask them if they think that higher housing right against the freeway is a good idea. I want to go back to the urban design plan as it was put in the Master Plan by Alan Jacobs that says that you want to see the City from the freeway. Steven Aiolla We would like to see improved the BART station heights. It needs to be a lot higher. The design review provision for buildings over 75 feet, we think that there needs to be threshold language to prevent debating of the policy. Jim Salinas, Sr. We strongly support staff's proposed change to make the middle income requirement to confirm the financial feasibility analysis. John O'Connell We support the date of August 3 rd , 2007 as a grandfather date because that was the date that the industry got the first notice that there were fees moving forward.show more
